FELONIES

A felony is defined as a crime which carries with it the potential for over 1 year of incarceration. When more than one year of incarceration is imposed, a defendant is typically looking at spending time in the custody of the Department of Corrections, i.e. prison.

In Oregon there are three classes of felonies:

1. Class A – with a maximum penalty of 20 years in prison and a fine not to exceed $375,000.00. Examples of this type of crime include Rape in the First Degree, Murder, Burglary in the First Degree, Manufacturing Drugs, Robbery in the First Degree, Assault in the First Degree, etc.

2. Class B – with a maximum penalty of 10 years in prison and a fine not to exceed $250,000.00. Examples of this type of crime include Delivering (Selling) Drugs, Burglary in the Second Degree, Assault in the Second Degree, Rape in the Second Degree, Robbery in the Second Degree, Abuse of a Corpse in the First Degree, etc.

3. Class C – with a maximum penalty of 5 years in prison and a fine not to exceed $125,000.00. Examples of this type of crime include Possession of Drugs, Auto Theft (Unauthorized Use), Assault of a Police Officer, Coercion, Failure to Register as a Sex Offender, Perjury, Criminal Mistreatment, etc.
